On January 15, 2021, the Pennsylvania Department State issued postcards to Pennsylvania corporations, non-profit corporations, limited liability companies, limited partnerships, limited liability partnerships that are not also limited partnerships, business trusts, as well as owners of insignias and marks used with articles and supplies that have not made a new or amended filing from January 1, 2012 thru December 31, 2021, requesting a Decennial Report be filed on or before December 31, 2021.
What is a Decennial Report and why is the Department requesting it be filed? The Decennial Report provides notice to the state of an entity's continued existence or the continued use of certain marks. These reports are made every ten (Decennial) years ending with the numeral "1", which makes 2021 the next filing cycle. The legislative intent for requiring these filings is to identify business names and marks that are no longer in use, so that they may be reissued and placed back into the stream of commerce. What happens if a Decennial Report is not filed on or before December 31, 20201? If a Decennial Report is not filed on or before December 31, 2021, the entity will continue to exist, however, it will no longer have exclusive use of its name. That means that the entity's names will become available for use by any other business registering in Pennsylvania. How do I file a Decennial Report? The Decennial Report is provided on the Pennsylvania Department of Stated website (DOS.PA.GOV) and requires a $70 fee. Contact Glenn J.
